What is the NOPAIN Act?
The NOPAIN Act, or Non-Opiods Prevent Addiction in the Nation, was enacted to address gaps in pain management during the opioid epidemic by expanding access to clinically proven non-opioid alternatives for surgical patients in the Hospital Outpatient Department (HOPD) and Ambulatory Surgery Center (ASC) settings for Medicare beneficiaries through December 31, 2027.
The NOPAIN Act requires Centers for Medicare and Medicaid (CMS) to unbundle Medicare Part B payments for qualified non-opioid treatments in HOPD and ASC settings.
This ensures that facilities receive separate payment for qualified non-opioid treatments without reducing the payment for the associated surgical procedures, and patients have greater access to these treatments.
Effective January 1, 2025, the Avanos ON-Q* elastomeric infusion pump and the Avanos ambIT* disposable electronic infusion pump meet qualifying requirements and are eligible for separate payment under the NOPAIN Act as outlined in the 2025 and 2026 Hospital Outpatient Prospective Payment and Ambulatory Surgical Center Payment System Final Rule.1
Effective January 1, 2026, the Avanos Game Ready GRPro 2.1 cryo-pneumatic compression pain management system meets qualifying requirements for separate payment under the NOPAIN Act.
The Game Ready GR PRO 2.1 Cryo Compression Device meets qualifying requirements and is eligible for separate payment under the NOPAIN Act as outlined in the 2025 and 2026 Hospital Outpatient Prospective Payment and Ambulatory Surgical Center Payment System Final Rules.¹
What Does This Mean for Avanos Pain Pumps and Your Facility?
The NOPAIN Act improves patient access to ON-Q and ambIT infusion pumps for post-surgical pain management by providing separate reimbursement for these devices when deemed medically necessary. This eliminates financial barriers that may exist when the cost of the infusion pump is bundled into the payment for a covered surgical procedure.
Both the ON-Q and ambIT infusion delivery systems received unique HCPCS codes for separate payment in the HOPD and ASC settings, marking the first time both devices qualify for this payment. The separate payment is provided in addition to the covered surgical procedure. In the Hospital Outpatient Prospective Payment and Ambulatory Surgical Center Payment System Final Rule for calendar year 2025, CMS has included both ON-Q and ambIT – notably, these are the only infusion pain pumps included under the NOPAIN Act.
Billing and Reimbursement
The payment limitation calculated and published by CMS is up to $2,008.72 for the ON-Q and ambIT infusion systems and all disposable supplies and $1,997.16 for the Game Ready GRPro 2.1 pain management system, when deemed medically necessary and used in conjunction with a covered surgical procedure.
